Legal Question in Criminal Law in Virginia
I was caught by a police officer drunk in public and being under the legal drinking age. The officer decided to not press charges but to seek medical attention. Five months after the fact, the incident has been brought up in criminal court. Can I be charged with underage drinking or drunk in public if at the time of the crime, it was decided I would not be charged?

Yes, as long as 12 months have not yet elapsed since the incident occurred.
