Legal Question in Criminal Law in Virginia

Change Sentence to House Arrest?

My son is serving a 3 yr. term for drugs in VA. Due to closures in DOC, he made not make into the DOC system, spending all his time in private jail.

Is there a way that I(his mother) can petition the court to change is sentence to house arrest here in NM where I live?

My son very much wants to become a positive, productive citizen again. But if he does not get into the DOC, he will not have advantage to the rehab. services that will help him learn a trade, career, college, etc.

Is this possible? If so, how would I go about arranging and proceeding with this request?

Thank you in advance

Re: Change Sentence to House Arrest?

You might look into the possibility of utilizing the

federal Interstate Compact for the transfer of prisoners between states to see whether this might

be used to get your son transferred to a New Mexico prison facility. I do not see your son being released under house arrest but it's possible that he might be transferred from Virginia to a prison facility in the area where you reside.

Contact the New Mexico DOC as well as your congressional representatives for further information and possible assistance with this matter.
