Legal Question in Criminal Law in Virginia
Help Please
I was charged with assault and battery and the complaintant is the officer that arrested me and he is in Iraq and wont be at the trial. Can they still prosecute me without him being there?

Sure, they can always try which, of course, doesn't mean that they'll necessarily be sucessful without their chief witness.
