Your attorney may have an advantage in cross examining the officer who was just asked to

resign. But, keep in mind - the judge in a bench trial is the fact finder; if you have a jury they

are the factfinders.... they can determine whether the officers testimony against you is sound.

They determine the weight to assign. The case is simply not "just thrown out" because the

officer got into a little trouble. My guess is that you are in a better situation than if the officer

never did get in trouble. But nothing is a sure thing. You need an attorney who is great in cross examination if you are going forward.
