As long as the person has only been charged with a felony and not convicted
of same, it should not be a problem.

The convicted fellon must not be in constructive possession of the firearm. He must not touch it or have easy access to it. The problem is not getting charged in the first place. That saves a lot of problems. Law enforcement must be satisfied that the felon does not "possess" the firearm. Lock it up away from the felon.
