Legal Question in Criminal Law in Virginia

if you are charged with a petit larcency 18-296 in Richmond, Va what might

be the sentence if the item is less than $10.00? If this is a first offense

or a second offense what might be the sentence involved.

Some lawyers say that you might get a lesser sentence than a year and

others say that if the item is extremely less that there will be no jail/prison

sentence but community service and a fine. I have a client as a catholic

deacon who came to me and wanted to know if I could find out the answer

to his questions?

Also this individual mentioned to me that they have a disability called

"short term memory loss" or pseudo-dementia where they forget things

alot and have to write them down for fear of not remembering. Do this

have any effect on the individual's sentence?

I would go with the opinion of the other lawyers, i.e., no

jail but a fine with community service.

And, no, assuming the defendant receives the above sentence,

I would anticipate no further reduction due to short

term memory loss nor for any other mitigating

circumstance that might be claimed by this defendant.
