Legal Question in Criminal Law in Virginia
charges
I was charged with destruction of property, resisting arrest, drunk in public, and breaking a protective order the first two were nolle proseque an the last two were dismissed these charges happened on feb. 7th '09 on april 27th they brought back the two nolle proseque charges destruction of property, and resisting arrest but also they charged me again with drunk in public and also a felony assault of a officer wich I was never charged with an the commonwealth attorney doesn't like me and he was also my lawyer in '03 for other charges can they do that? An wouldn't that be a conflict of interest?

Yes, it would appear that "they" can, and, no, I see no conflict of interest in what you've described.
