Legal Question in Criminal Law in Virginia
Charges Nolle Processed
I was charged in Dec. for DWI and possession of marijuanna. The charging officer did not show up for the hearing therefore the charges were nolle processed. 8 months later the officer returned to this jurisdiction and recharged me with the charges that were nolle processed. Can this be done? I have not been in any trouble since this incident and planned to join the Army.

Re: Charges Nolle Processed
Yes, as long as the recharging was done within 12 months of the alleged commission of the misdemeanor offense.
