Legal Question in Criminal Law in Virginia
chg: dui, involuntary manslaughter, reckless
9 Driver & 20 year old driver had been drinking earlier. The passenger grabbed and jerk the wheel causing the car to go off the road, driver over-corrected and the car spun and slam side ways into a tree, killing one passenger, seriously injuring another. Would the passeenger be at any fault in this accident?

If the passenger to whom you refer is also the one who initially grabbed the wheel, it would seem to me that this person might be charged with involuntary manslaughter or another homicide charge of similar seriousness.
