Class 2 Misdemeanor

I was convicted of a Class 2 misdemeanor. I maxium fine is $1,000. The court fined me $2,500. Do I have to pay the $2,500 or can I just pay $1,000.

Re: Class 2 Misdemeanor

S18.2-11 of the Virginia Code prescrbes the punishment for conviction of a Class 2 misdemeanor as not more than six months in jail or a fine of $1000, either or both.

Assuning that you did not have a lawyer, I would check with the clerk's office of the court's criminal division to confirm that in fact you were convicted of a Class 2 misdemeanor as you claim.

If in fact the clerk confirms this and the fine of $2500, you should request a rehearing on the matter before the court and an adjustment in the amount of the fine,
