Legal Question in Criminal Law in Virginia
classification issues with VaDOC
My husband is in Powhatan Correctional Center, a level 3 prison. However, he is in prison for a probation violation and is a level 1. I have written the VaDOC superintendent and he said that I was correct about the classification issue and he would refer it to the classification dept. That was 2 months ago. He's been in this level 3 prison going on two years!! I just want to know what help I can get to get him transferred to a level 1 prison where he is supposed to be? Is this an issue for a lawyer in other words, since the DOC doesnt seem to be concerned for his safety?

This matter might well involve more politics and bureaucratic inertia than any substantive legal issues. Consequently, you might wish to contact your state representative(s) to see what pressure they might bring to bear on the Department of Corrections in order to resolve the issue.
