Legal Question in Criminal Law in Virginia
US Code 18 USDUSC 1029
My spouse (according to a legal inquiry) was cited with 1 count of mail fraud issued as a warrant back in early 1996. No other warrants were issued to our knowledgle, as clearly as an attorney could find in a search done at the end of 1996. The warrant was never executed. Several months ago I spoke with a prominent Federal defense attorney and described the situation as above. I was told that the warrant was quashed-dismissed without prejudice in 2003. The warrant was issued under US Code 18USDDUS 1029. I have read this code, however I am somewhat confused. This US Code does not appear to be related solely on a mail fraud charge. Yes, there was a credit card involved, but I remain concerned because I see other US Codes which apply more directly to mail fraud. Title 18 chapter 63, appear to me to be more directly related. I am curious why the Postal service would have filed under Title 18 1029? Is this something unusual? I have paid several internet sites to be sure there are no outstanding warrants as a result of the 1996 issue. I can find no one who can access ncic database, or nics database. What searches I have done show nothing. But I do not know how reliable the results are. The main concern is, was there a second warrant

Title 18, Sec. 1029 of the U.S.C. concerns fraud and illegal activity related to so-called "counterfeit access devices". Without knowing more as to the particular details of your spouse's alleged fraudulent activities, there's no way to fairly assess the likelihood as to whether
additional charges may have been brought under other statutes.
However, if the one warrant that you you know about was supposedly quashed
back in 2003, chances are that by now, there are no others related to this alleged crime still outstanding after more than 10 years from the commission of the offense alleged.
