Conflict of Interest
Can a mistrial be declared if the court appointed defense attorney in one county in Virginia served as the prosecuting attorney in another Virginia county against the same client?

Not, too likely, absent a showing of a demonstrable conflict of interest which is not the case merely on the basis that the defendant's defense counsel was previously a prosecutor who prosecuted him in another case.
