Consequences of driving on a suspended license due to refusal to take the bretha

I would like to understand the possible consequences of conviction of driving on a suspended license which was suspended due to a conviction of refusing to take the brethalizer test.

Such prohibited operation of a motor vehicle could result in the driver being charged with DWS(Driving While Suspended), a Class 1 misdemeanor punishable as a criminal offense, with up to 12 months in jail, a fine of $2500, either or both.

As I understand the law in Va., it is perfectly legal to operate some types of street legal scooters and minibikes, even if your license is suspended following an alleged DUI.
