Convicted of Felonies

My son mother recently plead guilty to 3 felonies. However, noone in her family will tell me about the case. How do I find out what she was convicted of and how much time she has received. I don't know if it's a state case or federal case, therefore, I don't have any type of docket number. What steps do i need to take to secure full custody of my son and to stop child support.

This might be simpler than it appears. If I were your lawyer, and I'm not, I might go to court with a motion for custody and serve her with the motion at her last known address. I assume that you don't know for sure that she is in jail or that her address has changed. I assume she would not show up for her court date. I assume she would lose.

try calling the clerk of the circuit court for the county in which you think she was convicted. ask her if they can tell you any information on the Commonwealth v. ________. As far as obtaining custody, go to your local juvenile and domestic relations court intake office and file a petition for custody. It'd be a good idea to hire an attorney for this...

It's more likely that the person in question was prosecuted by the State than by the Federal Government. You can conduct a county by county check of the public records in Virginia by going to http://www.courts.state.va.us

Once you have found what County she was prosecuted in, you can call the clerk of the court for that county and find out what happened. In cases not involving Juveniles, that information would be a matter of public record.

As far a child custody, you would need to petition the Court to award you custody, and that is something that is probably best done with the assistance of an attorney due to the potential complexity of the legal proceedings involved.
