Legal Question in Criminal Law in Virginia

Hi, i was not convicted of a grand larceny charge roughly a year and a half ago, but it would show up on my record if i did something wrong. Last night, i was around people who were smoking weed, but i did not participate. The owner of the car took the blame for the paraphernalia and weed. What am i looking at for punishment? I am 17 years of age.

It sounds to me like you may have a good defense to a charge of possession of marijuana.

Follow this link for more information on what the prosecution has to prove to get a conviction for that charge, and what possible defenses might apply : http://www.spranolaw.com/Criminal-Defense/Possession-of-Marijuana.shtml.

In my opinion, possession cases are usually easier to fight than many other charges. You want to be careful and avoid a grand larceny conviction by catching a new conviction. Are you stating that you had a deferred disposition on the grand larceny charge? I would require more facts regarding the possession charge. Did you confess to anything? Where were the alleged drugs discovered? Where were you located? What amount of the alleged controlled substance was discovered? Etc. In addition, minors are treated differently in most instances when it comes to sentencing. That is a whole new subject.
