Legal Question in Criminal Law in Virginia
i was convicted of Malicious Wounding in the Circuit Court of Norfolk, Va. back in 1995 while in the military. Since then, i have not been in any more trouble, completed 15 years probation early (11/16/05), paid off restitution fee and retired from the military. The judge that sentenced me (Judge, Luther C. Edmonds) was convicted and disbarred in 1997 for the same crime. After retiring from the military and looking for a job this conviction keep coming up. Can i get this expunged or sealed in my records

Not a chance, friend, irrespective of what Judge Edmonds may have been convicted of (in my opinion). See Va. Code Sec. 19.2-392.2 et seq. which makes clear that expungement of police and/or court records in the Commonwealth is only for those who are innocent and is not applicable to those who either plead or who are found guilty (after trial) of criminal offenses.
