I know a person that was accused of touching a child that has a habit of telling lies. He left his wife and she waited a month to press charges against him. I know he did not do it. To make a long story short, he hired a school friend to defend him and he paid him up front. He was offered a plea deal and did not take it because he did not do it. He is getting ready to go to court in few weeks and his attorney has not done anything (supoened anyone). He is having a jury trial. Is it too late to get a new attorney and is it legal to get a private investigator to check out allegations in the child's school that she has talked about boys in school touching her? Also can the mom be investigated due to lies that she has told also?

If the current counsel has not properly prepared the case for trial, the defendant may wish to discharge him and request additional time from the court to hire new counsel and to prepare the case for trial. (A defendant in a criminal case will usually be granted at least one continuance as a matter of course.) And, yes, a private investigator could be engaged to assist with such preparation by conducting investigations of matters relevant to issues in the case.
