Cross examination question
During cross-examination, is it permissable to ask what physical evidence the accuser has to prove that he didn't particapate in the alleged offense? My girlfriend and I had a credit card together and she is now trying to say that she had no knowlege of it,after we broke up because she thought I was cheating on her, and I was charged with Identity Fraud. The only evidence offered by her at the preliminary hearing was her ''saying'' that she did not open the account. We lived together for a year before the break up and these alleged charges were filed.I don't qualify for a public defender and I can't afford to hire a private one.

Your questions of the prosecution's witnesses on cross examination must be limited in scope to what was covered on direct examination of them by the prosecution. If your question does not relate to something that was actually referenced in the direct questioning of the witness, the prosecutor may object to it as being "beyond the scope of the direct" and the court will likely sustain the objection.
