Legal Question in Criminal Law in Virginia

My daughter is involved in case of embezzling around $5,000 worth of groceries from our local Harris Teeter. She was an employee there, but was fired. She was fully cooperative, gave a full confessions, and is willing to pay restitution. She has no previous criminal history, and is 18 now. Do you think with our attorney that the company will be willing to settle out of court? I assume it will involve paying full restitution, community service, and maybe some other things. I was just wondering if we have a good chance that they will be willing to settle outside of court.

Would seem to depend upon whether your daughter

has been criminally charged or not, but, if so, then the disposition

of the matter would lie with the local office of Commonwealth's

Attorney rather than with the Harris Teeter store which was victimized.
