Legal Question in Criminal Law in Virginia
I had a daughter recently charged with possession of a weapon. She was in a vehicle with a person whom had a weapon. He admitted to having it and was released. She had no idea it was in the car. At the hearing her attorned pointed out that on the invventory sheet provided there was no magazine listed. The officer nonchountly stated - oh, I must have forget! Can she be charged?

Apparently, she's already been charged; the operative question is whether
she could be convicted of this charge based upon the relevant facts on which
the charge is based.
And, merely because the inventory of the item(s) seized by the police may include a gun supposedly without a magazine in no way implies that your daughter is necessarily "off the hook", so to speak, in regard to what appears to be a charge still pending (in my opinion).
