Legal Question in Criminal Law in Virginia
death threat
My childs father, who has had no contact with her in over two years , by phone or in person, happen to see a mutual friend out and ask how we were doing. She said fine. He flipped out and said that he loved his little girl and hated me so much for not letting me see her ( keeping in mind that he has never tried) and that he wished I was dead, that he wished someone would kill me, that I would die like josh did ( a person we knew in a car wreck ). It has really bothered me since i heard this. One because yes, its my life, and two I think should I really be worried about him doing something to my car or to me? I am now married and have a baby along with his little girl.
I want to know should I do something about this? Is this something that can be done? Charges to be pressed? Or am I overexaggerating?I know you arent familar with our story but we truely havent spoken in two years. Not once. I have lived my lived without his drama, alcohol, or drugs just fine, and he has lived his with rehab and full of everything including jail.

Re: death threat
What you have described the law terms essentially hearsay, i.e., statements coming from a third person and not directly from the alleged declarant, which could be true, partly true, but, perhaps, somewhat exagggerated, or completely untrue. How can you be really sure which applies to the statements related to you by your friend?
Threatening a person with death or serious bodily harm can be illegal, but more than hearsay statements are required to make it actionable.
As long as your situation continues as it has been with no contact from your child's father, I doubt that you have much to be concerned about.
