Depends upon how much money was taken and the circumstances
under which it was taken.
Embezzlement itself in the Commonwealth is defined as larceny
which can be either grand or petit, per Va. Code Sec. 18.2-95
or Va. Code Sec. 18.2-96, respectively. (Petty larceny
is classified as a Class 1 misdemeanor rather than a felony.)
