can i be convicted of domestic assault in the state of virginia if there were no witnesses to the alleged act and the alleged victim will not testify

Hard to say, nevertheless, you should be asking this question of your defense counsel who, hopefully, by now has either been hired by you or appointed by the court to represent you in the event that you are unable to afford to hire such on your own.
Under no circumstances should you attempt to deal with this matter on your own without the assistance of competent legal defense counsel.
