drive by shootings
group gang members engage in drive by shooting killing an innocent by stander. how is the driver charged, the actual shooter and the other passengers charged?

Would likely depend upon the relevant facts as they might apply to each of the occupants of this particular vehicle, including, of course, the driver himself.

the shooter and the driver will be charged with the same crime with the driver being criminally liable as principal in the second degree for aiding and abetting the shooter. The passengers may or may not have liability depending on what they did.
