Legal Question in Criminal Law in Virginia

dropping charges

i was involved into a robbery case and the victim wants to drop the charges because it was not a robbery, but rather a misunderstanding that the police misinterpreted. Can he drop the charges? and if not, can he talk to the DA about it? and if not, what else can he do?

Re: dropping charges

No, victims of any crime allegedly committed against them in the Commonwealth have no power to decide on their own that charges against an alleged perpetrator should be dropped as only the local office of the Commonwealth's Attorney charged with the prosecution of such a crime has that authority.

However, the alleged victim can certainly attempt to explain to the prosecutor assigned to the matter as to why he or she believes that the matter should be dismissed and further prosecution not pursued.
