Drug diversion from hospital

One of my recovery sponsees (narcotics anonymous) has had a call from the Virginia State Police wanting to talk with her about diverting narcotics from the hospital where she used to work as a nurse. She spent the summer in a treatment center and has no job hence she cannot afford a lawyer. Should she ask for a public defender for the questioning? She has yet to be charged with a crime. If charged, this would be her first offense...will she go to jail? Please advise.

Under no circumstances should your sponser/friend agree to talk with the state police, without first consulting with a competent and knowledgeable criminal defense attorney. In the event that she cannot, for whatever reason, secure such counsel, she should continue to refuse to talk with police on the grounds that she has not been able to first consult with a criminal defense attorney.
