DUI in the Commonwealth is classified as a Class 1
misdemeanor, punishable by a fine of up to $2500
and/or one year in the local jail. Sec.18.2-270 Va. Code (First time offenders rarely receive any jail time which they must serve and the fine which they receive might average around 1/3 of the maximum.)
