Felonies are not expungable in the Commonwealth unless you can prove that you were wrongfully convicted and have received a pardon from the governor.
(See Va. Code Sec. 19.2-392.2 et seq.)
Misdemeanors may be expungable under Sec. 19.2-392.2(C)for a first time offender if the Commonwealth doesn't have "just cause" to oppose it.
