Legal Question in Criminal Law in Virginia
Espungement
My son was charged with petty larceny in 2003 but at the trial it was changed to trespassing. So the charged he was convicted of was trespassing. He was really innocent. He recently graduated from collge 5/2008 and can not get a job because he can not past the criminal background check because of this charge. Is there anyway to get this charged espunged

Yes, it may be possible for a first time offender with only a misdemeanor conviction. See Va. Code Sec. 19.2-392.2(C).
