Legal Question in Criminal Law in Virginia
Evidentiary Hearing
We are awaitng an evidentiary hearing in hopes of having a mistrial granted. The reason for the hearing is because it's alleged that one of the juroros knew at least two of the Commonwealth's witnesses and was dishonest about his relation to them. All three are members of the same local organization. The organization's clubhouse is the location that the crime occurred. With their affiliation as well as the juror purgering himself in vior dire, would that be enough prejudice to grant a mistrial?

In the Commonwealth of Virginia's criminal justice system, I would not bet on it.
