Legal Question in Criminal Law in Virginia
Excessive Force?
My friends and I were in my vehicle when we were stopped on a parking lot by the police who had guns drawn and pointed directly at us, because the call went out wrong and they thought they were responding to a robbery, it was actually a misdemeanor shoplifting charge, but we were treated as if we had robbed a store. Is it lawful for the police to approach us with guns drawn over a misdemeanor shoplifting charge?

Re: Excessive Force?
Yes, it could be quite lawful, even if the matter only involved an alleged misdemeanor shoplifting charge.
