Legal Question in Criminal Law in Virginia
can you expunge a null process charge? I was charged with a bogus hearsay charge to make a misconduct and general noise charge stick . this was almost 10 years ago and i want to remove it from my recod . is this possable if the charge is null process and also can you have somthing you were charged with removed at all in any circumstance ?

Under Virginia Code any charge that is dismissed or disposed of by motion nolle prosequi (nolle prossed) can be expunged by following the process set out in the Code. You may wish to consult an attorney about assistance with the process.
