Legal Question in Criminal Law in Virginia
Expungement Vs. Sealed
I have been convicted of 3 misdeameanors of assault and battery over a messy divorce. These charges are prohibiting me of getting employment. I tried to do some research online. My understanding is an expungement can only occur if you were not convicted but I am not sure if sealed is the same thing. I read sealed means you are convicted but it would not appear to the public nor an employer. I am confused and need some clarification.

Re: Expungement Vs. Sealed
Yes, that's correct, i.e., you cannot receive expungement if you already have a record of a misdemeanor conviction. (See Va. Code Sec. 19.2-392.2 et seq.)
Sealed records of convictions in domestic realtions matters apply mainly to juveniles.
