Legal Question in Criminal Law in Virginia
expunging a felony
My husband has a felony from when he was 18 he wrote a bad check....He is 33 now and never been in any trouble , we have two children and he volunteers for the fire dept. ...this is holding him back from many things like teaching our boys to hunt and certain employment opps. . Can we request this to be expunged on our own and if so where do I start?

Re: expunging a felony
The record of conviction for a felony is not expungable in the Commonwealth of Virginia, unless the convicted one can demonstrate that he or she was wrongfully convicted and has received a pardon from the governor. (See Va. Code Sec. 19.2-392.2 et seq.)
