Legal Question in Criminal Law in Virginia
expunging my record (class 1 and 6 felony)
On Nov 30th 2001: I was charged with poss- intent to distribute, sell, and manufacture a class 1 substance (mdma) aka extacy. I was also charged with distribution of an imitation controlled substance class 6 felony.
On Oct 28th: I was sentenced to 11 months, 9 of which were suspended; in the Fairfax county detention center.
3 years probation was suspended because I had an open US.ARMY contract- my ship date was Jan 6th 2003.
I was released mid November. I had 33 days time served from my initial arrest.
I never went to a state or federal prison, nor was I fined over the amount of $1100.
I am now a highly decorated combat veteran, whom never was what I was convicted of. I would love to continue to protect our nation�s security.
What can be done in my situation? Please help.

Records of criminal convictions in the Commonwealth of Virginia, unfortunately, even for "highly decorated combat veterans", are not expungable, unless you were wrongly convicted and
can prove it and have received a pardon from the governor. (See Va. Code Sec. 19.2-392.2 et seq.)
