Legal Question in Criminal Law in Virginia

Expungment for Drug Court Related Charges

Once a person has graduated the drug court program here in Roanoke, the disposition is listed as dismissed. Since the drug charge is listed as a felony is it still up for an expungment? Prior to accepting this program the person in question was informed that sucessfull completion of this program would clear their record as if they were never charged. The charge was 18.2-248 Dist.Meth

Thanks for your help.

Re: Expungment for Drug Court Related Charges

Records of criminal convictions in the Commonwealth of Virginia are not expungeable unless the convicted one can prove that he or she was wrongfully convicted and has received a pardon from the governor. (See Va. Code Sec. 19.2-392.2)
