Your question does not clarify whether this involves a person found guilty or found innocent. Expungement usually applies when a person was either found innocent or after they have fully paid all their sentence, etc. In Virginia STATE court, expungements are limited and difficult.

However, when you write the "appeal time has expired" I wonder if you mean someone who was found guilty.

In generaly, the answer is yes, but most attorneys do not know how to do it. I work with a legal consultant who is a criminal defense genius. He and I can as a team (I am a licensed Virginia attorney) can do whatever is possible, and some things that are the impossible.

My consultant friend has (working through local attorneys) successfully overtuned actual convictions, after the trial is over, by finding defects in the charges, etc.
