Legal Question in Criminal Law in Virginia

Exsponging old Crimes

I have an old Larceny (exactly 1997)on a criminal record. How do I go about having it removed permanently? This crime was dismissed in Court but it keeps showing up to punish me.

Re: Exsponging old Crimes

An crime may be expunged if it was NOLLE PROSSED (a chooice by the commonwealth not to prosecute) or if you were fund NOT GUILTY. Any finding of guilt or if you admitted that the evidence was sufficient to convict, then the charge cannot be expunged. If it was then you must file a Motion for Expungement in the Circuit Court where the crime was prosecuted. You should hire a competent criminal defense attorney to do this. People should not represent themselves in Court.

Good luck.
