Legal Question in Criminal Law in Virginia
I am facing assault against a family member in the state of VA. I have a clean record no prior convictions my question is what is the best way to be able to get this charge dismissed where it will not appear on my record. The incident occurred between my brother and I am argumet arose where he spit in my face I open hand hit him, however a phone charger was in my hand which caused a small laceration on his cheek. Probably, your best hope for such a disposition, i.e., dismissal of the case without a record
of conviction is if your accuser, i.e., the Commonwealth's chief witness in the matter, fails to show up for the scheduled trial (for whatever reason) to testify against you.
