Legal Question in Criminal Law in Virginia
failure to appear
If you are charged with assault and battery. Go to court and the Judge dismisses the case on a future date as long as there is no problems in that time. Did not have to sign a notice to appear in court. There was no problems and did not go to the future court date. You find that there was a warrant for your arrest. Turn yourseld in and they say they have no record that it was to be dismissed because maybe they cant read the hand writing. Again didnt sign a notice to appear on the future date. What can be done to take action for the mistreatment of the court to you. Lost job offers because background checks showed you are a fugitive. Please help.

Re: failure to appear
I would suggest that you plan to appear
in court on the future date that you claim you didn't sign to appear for in order to clear this matter up and to prevent the issuance of another capias(warrant) for your arrest.
If there's blame to go around for whatever caused this matter to go unsettled, my sense is that a fair amount of it probably lies in your corner.
