Legal Question in Criminal Law in Virginia

Failure to perform community service

In 1994 I was convicted of a felony for grand larceny that involved taking a car tire. This was my first and only conviction. The larceny involved another individual who took tires from a car and because i was in the vehicle of the primary defendant while he took tires off a car i was considered a co conspirator. My court appointed lawyer told me i should pled guilty because of it being my first offense. The judge accepted a plea bargain of my doing 100 hours community service, pay restitution and being of good behavior for 1 year which would then reduce my conviction to a misdemeanor. The judge instructed my lawyer to provide me with a place to perform the service at and to let him know. My lawyer did not do this and I attempted to find places to perform the service at but because I thought I was already a convicted felon I was telling all of the places this which led them to turn me down saying they didn't take felons. At this time I was working two full time jobs and considered the court to be pleased with this because one of my jobs which was seasonal would let me do the service there at the end of the season. The judge didn't see it this way and gave me the felony anyways. Is there a way to still get this reduced to a misd.

No, there isn't. You shouldn't have waited 12 years to address this issue.
