Legal Question in Criminal Law in Virginia

Fair Treatment

A school teacher was accused by an child that he was sexually molested a year earlier. The childs parents, who had overheard the child, contacted the police who arrested the teacher, jailed without bond. Does this sound legal, locking a person up on the word of a child, without any investigation. What, normally, is the process?

Re: Fair Treatment

What you have described, unfortunately, is quite often still the process, not only in Virginia but many other jurisdictions.

Although the hysteria that surrounded these kinds of cases back in the 1980's and early 1990's when many innocent people were charged and quite often convicted, soley upon the word of impressionable young children who had been coached by social and child protective services workers, has abated somewhat, innocent people, as your question demonstrates, are still being charged in these cases on the basis of highly dubious evidence.
