The maximum penalty for a Class 6 felony under the Virginia code is 5 years. However, possession as a convicted felon carries mandatory minimum sentences depending on the underlying felony. The mandatory minimum can be either 2 or 3 years depending on the underlying felony. So being charged with a count of 18.2-308.2 is very serious.
