Legal Question in Criminal Law in Virginia

My father was being investigated for drug sales in the state if Virginia three years ago. Before he was charged with anything they filed a lien against the house saying it came from drug proceeds. Nothing ever came from it, and he was never charged with anything. A year later he was arrested in Pennsylvania for federal drug charges that never had anything to do with Virginia. Two days after his arrest county police officer went to his house in Virginia and took his cars, boat and motorcycle. They sold all the vehicles and still have the lien on the house. He has finished his federal sentence of two years, and he is out now. We have had a renter in the house for Virginia paying the mortgage the whole time. He now has to show up to a civil suit to try and keep his house. He has a legit pay history to show the house payments never came from any drug money. How can they take the house if they never charged him with anything? and what does he need to do to keep it? Can he appeal if it doesn't go his way?
