Legal Question in Criminal Law in Virginia

First felony

I was arrested for felonious assault on my girlfriend with whom I lived. We had an all night party where we both used drugs and alcohol. We were black out drunk and got in a fight which neither of us can remember clearly. She did not file a complaint, the town officer who was called for the disturbance did. I have never had anything other than two misdemeanor charges. How can I expect this to turn out?

Who knows (given the scarcity of facts as to how your case will turn out)? However, what is knowable right now beyond any reasonable doubt is the necessity for you to to engage promptly the services of competent defense counsel to represent you in this matter and if you cannot afford to hire such you should request that the court handling your case appoint one to represent you.

Firstly, the fact that you have two misdemeanors in your past must be analyzed as they may play a role in sentencing -should the case come to that juncture.

However, I believe there may be issues with the government's case if BOTH you and the alleged victim were drunk. I would need to learn the statements made by your girlfriend and if there are any pictures of injuries.

This is certainly a case I see going to trial.
