Legal Question in Criminal Law in Virginia
Hello ,
I have a felony conviction for 3 DWI's within 10 years. It has been over 5 yrs since my last DWI, I am a Computer Technician who can't get a job because of my conviction. I have no other criminal offenses. Is there anyway to get my record sealed or expunged ? I need help !!
1 Answer from Attorneys
Unfortunately, no. Expungement of criminal records of conviction in the Commonwealth applies only to those who have been acquitted after trial,
or have had their charges dismissed or nolle prossed before trial. In other
words, the Virginia expungement statute found at Va. Code Sec. 19.2-
392.2 et seq. is for those who are basically considered innocent and not
for those who have either pled guilty or been found guilty after trial.
