Legal Question in Criminal Law in Virginia
Got in a fight with roommate. Both charged with assault & batt. We want to drop, but can't. How do we tell the judge in court?

Unfortunalely, it's not up to the judge in this type of circumstance as to
whether criminal charges may be dropped at this stage of matters, but rather the local office of the commonwealth's attorney which "papered' the cases in the first case.
The two of you alleged "batterers" could contact this office and ask to speak with
the Assistant Commonwealth Attorney responsible for prosecuting the case(s) to determine whether she/he might consider dismissing these charges.
