Legal Question in Criminal Law in Virginia

Fired for retail theft,

My nephew was fired for the night deposit being $200.00 short. He was questioned by the police, volunteered to take a polygraph but so far no charges have been filed and he hasn't been arrested. Should he hire an attorney at this point or does this mean he doesn't have to and wouldn't be arrested in the days or weeks to come, then have to try and hire an attorney at that point. Any assistance is appreciated....Thank you!

It would probably be best to at least contact an attorney at this point. The attorney can contact the State Attorney had inquire as to the status of any potential charges, and also arrange for your nephew to turn himself in and arrange a bond. This way your nephew could avoid any extended time in jail upon arrest.
