Legal Question in Criminal Law in Virginia
Food stamp Fraud accusation
I have been accused of food stamp fraud. Dpt. of Social services is saying I did not notify them of income changes. I did, and have proof, they say is not goo d enough. My social worker was out, and replaced with a temp, who did not return my calls or document faxes, or anything, she ignored any changes I reported on my case. They have tried to take me to court twice. First time, DSS did not show, second time, they lacked evidence, and their attorney did not show. They still want me to repay atleast $2000, and Ido not believe I should repay this for their mistake, and lack there of. I now, would like to file a suit against them. How do I do this, and what kind of suit would I file? Thank you.

Re: Food stamp Fraud accusation
Assuming that the Virginia authorities had a reasonable basis to prosecute you for the alleged fraud and that their actions were not in any way malicious, it's very unlikely that you would have any credible basis for a lawsuit against either the individuals involved or the agency(ies)which they represent.
Also, given the fact that you may still be the object of this so-far unsuccessful prosecution, is another reason to consider your own situation very carefully before attempting any suit on your own.
